(a) DS Construction and Building Supply LLC, on or about September 5th, 2019, at the location of 4587 Cliffton Mill Rd., North Ridgeville, OH, 44039:  The employer did not implement and maintain accident prevention programs to make employees aware of the hazards while performing residential construction activities.  Employees were exposed to fall hazards while working from scaffolding, struck by hazards while operating and working around powered industrial vehicles, and potential flying object hazards while using pneumatic nail guns.

(a) DS Construction and Building Supply LLC, on or about September 5th, 2019, at the location of 4587 Cliffton Mill Rd., North Ridgeville, OH, 44039: The employer did not ensure that employees working from a forklift mounted scaffold were trained regarding the nature of fall hazards in the work area.  Employees were exposed to fall hazards of approximately 18 feet while using the Haugen work platform.

(a) DS Construction and Building Supply LLC, on or about September 5th, 2019, at the location of 4587 Cliffton Mill Rd., North Ridgeville, OH, 44039: Employees using pneumatic nail guns to perform residential construction activities were not protected from potential flying particles through the use of eye or face protection.  Flying particles could potentially strike and damage the employee's eyes.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  (a) DS Construction and Building Supply LLC, on or about September 5th, 2019, at the location of 4587 Cliffton Mill Rd., North Ridgeville, OH, 44039: Employees were utilizing a JLG Skytrak that was not being examined on a daily basis for any condition adversely affecting the safety of the vehicle.  Failure to complete such examinations exposed employees to potential struck-by, crushed by or fall hazards due to defects or malfunctions of the powered industrial truck which was being used to support an occupied Haugen work platform.

(a) DS Construction and Building Supply LLC, on or about September 5th, 2019, at the location of 4587 Cliffton Mill Rd., North Ridgeville, OH, 44039: Employees were exposed to fall hazards of approximately 18 feet while using the Haugen work platform.  The employee stood on the guardrail of the scaffold and was not protected from falling to the lower level or the ground below.
