29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  (a) Jobsite located at 21 Excell Lane, Willingboro, NJ: The employer failed to provide training to employees on the recognition and avoidance of unsafe conditions related to trenching and excavations, prior to the start of working. On 8/30/2019 an employee was hospitalized after being caught in a trench collapse.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  (a) Jobsite located at 21 Excell Lane, Willingboro, NJ: On 8/30/2019, the employer directed an employee to enter a trench which was not provided with protective systems tp protect against cave-ins.. The trench collapsed injuring the employee resulting in an in-patient hospitalization.  NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization.  a) W.C. Fallows Plumbing, jobsite located at  21 Excell Lane in Willingboro, New Jersey: On August 30th, 2019, at approximately 11:30 am, an employee was involved in a trench collapse resulting in hospitalization of that employee. OSHA was not notified of the hospitalization until 9/12/2019, which was not within the 24 hours reporting time frame.
