29 CFR 1926.451(g)(1)(iii): Each employee on a crawling board (chicken ladder) shall be protected by a personal fall arrest system, a guardrail system (with minimum 200 pound top-rail capacity), or by a three-fourth inch (1.9 cm) diameter grab-line or equivalent handhold securely fastened beside each crawling board.    On September 16, 2019 at 8093 St Hwy 57 in Baileys Harbor, an employee was using a chicken ladder/crawling board on a roof thirteen feet above surface level without utilizing fall protection equipment.

29 CFR 1926.452(m)(2): Crawling boards shall be secured to the roof by ridge hooks or by means that meet equivalent criteria (e.g., strength and durability).    On September 16, 2019 at 8093 St Hwy 57 in Baileys Harbor, an employee was using a chicken ladder/crawling board on a steep roof surface thirteen feet above surface level without the chicken ladder secured to the roof.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.        a)   On September 16, 2019 at 8093 St Hwy 57 in Baileys Harbor, an employee was working from a main roof twenty feet above surface level without utilizing fall protection equipment.      b)  On September 16, 2019 at 8093 St Hwy 57 in Baileys Harbor, an employee was using an extension ladder to access/egress a porch roof twelve feet above surface level and was walking on the porch roof and a south side house addition roof with unprotected edges to access/egress the main roof without utilizing fall protection equipment.
