29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a)  At 24565 Perdido Beach Boulevard, Fat Daddys Arcade, Orange Beach, Alabama:  On or about September 17, 2019 and at times prior; the employer allowed his employees to perform painting activities from a ladder jack scaffold without providing a separate ladder for employees to get on and off the scaffold platform exposing his employees to a fall hazard of up to 22 feet  8 inches to the ground below.

29 CFR 1926.452(k)(1): Platforms shall not exceed a height of 20 feet (6.1 m):  a)  At 24565 Perdido Beach Boulevard, Fat Daddys Arcade, Orange Beach, Alabama:  On or about September 17, 2019 and at times prior; the employer allowed his employees to perform painting activities from a ladder jack scaffold and the scaffold platform was 22 feet 8 inches above the ground below exposing his employees to a fall hazard of up to 22 feet  8 inches to the ground below.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  a)  At 24565 Perdido Beach Boulevard, Fat Daddys Arcade, Orange Beach, Alabama:  On or about September 17, 2019 and at times prior; the employer allowed his employees to operate aerial lifts on site without fall protection exposing his employees to a fall hazard of up to 15 feet to the ground below.

THE TONYS PAINTING OF DESTIN, INC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.451(G)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER  1024650, CITATION NUMBER 1, ITEM NUMBER 3 AND WAS AFFIRMED AS A FINAL ORDER ON APRIL 25, 2015,  WITH RESPECT TO A WORKPLACE LOCATED AT 208 JACK KNIFE DRIVE, LOT 29, WATERSOUND, FLORIDA.
