29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:   The employer is failing to ensure that the eyes and face of employees are protected from flying particles while working on a residential roof.  This most recently occurred on October 3, 2019 on the jobsite located at 230 S. 85th St, Omaha, NE 68114.  Employees were observed using hand-held pneumatic nail guns to install shingles on an existing single-story house without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:   The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection.  This most recently occurred on October 3, 2019 on the jobsite located at 230 S. 85th St., Omaha, NE 68114.  The owner and 4 employees were re-roofing an existing single-story residential house and not utilizing any form of fall protection.  The house has an 8 in 12 steep sloped pitch and ground to eve height is approximately 9 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   The employer is failing to ensure that each employee exposed to fall hazards has been effectively trained on fall hazard recognition and the use fall protection.  This most recently occurred on October 3, 2019 on the jobsite located at 230 S. 85th St., Omaha, NE 68114.  The employer has 4 untrained employees working on a residential roof without fall protection or an understanding of the requirements for working at heights greater than 6 feet.
