29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) (a) New residential construction located on Lot #597, Second level deck: On or about 10/03/2019, and at times prior, the employer failed to perform frequent and regular inspections of the job site, in that the employer did not inspect crews or jobsites to enforce the use of fall protection as no management official was located on the job and fall protection usage was not established by the employer.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New residential construction located on Lot #597, Second level deck: On or about 10/03/2019, and at times prior, the employer exposed employees to fall hazards greater than 11-feet, 11-inches from the lower ground level, in that a fall protection system was not used by employees engaged in deck framing activities.
