29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference 1926.59):  a) At the construction site, a written hazard communication program had not been developed and implemented.  Employees were exposed to hazardous substances such as silica when using Portland Cement, Lime & Sand Mortar.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s) (Construction Reference 1926.59):  a) At the construction site, where a safety data sheet (SDS) for Amerimix Portland Cement, Lime & Sand Mortar, a corrosive containing silica, was not readily accessible in that the employer did not have an adequate back up system for the SDS to address emergency situations.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:  a) On the second floor of the garage building, Tubular welded frame scaffolding was not equipped with a ladder. Cross bracing was used as a means of access.
