29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    location: shop area, VMC-13 vertical mill  On or about 10/16/19 the employer did not develop and implement a hearing conservation program for an employee exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while operating a CNC vertical mill. The employee was exposed to noise level at 69.2% dose which is above the action level of 50% dose (85 dBA) during the 483 minute sampling period. The equivalent level of the 69.2% dose is 87.2 dBA for an 8 hour Time weighted Average (TWA).

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    Location1: lathe station  On or about 10/9/19 the employer did not ensure employees operating a lathe, a San Shing Machine Industrial model SE 2880, was protected from rotating parts and flying chips.    Location 2: band saws  On or about 10/19/19, the employer did not ensure employees operating three horizontal band saws, one a Kalamazoo HB-03, one a Cocen C-325NC and one a Cocen C-300NC were protected from the point of operation by the unused portion of the saw blade.
