29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a) Excavation behind F. Wilbur Gingrich Library - An employee operated equipment to dig the excavation, including doing the sloping and benching, on or about October 1, 2019.  A worker entered the excavation to do work, on or about October 3, 2019.  The employee who dug the excavation required instruction on design of benching and sloping systems because the benching and sloping used did not comply with 29 CFR 1926.652(b), creating hazards, including, but not limited to, getting struck-by sliding/falling soil and rocks.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):    (a) Excavation behind F. Wilbur Gingrich Library - On or about October 3, 2019, a worker entered the excavation, dug in Type B soil, and worked in the vault at the bottom of the north end, which measured 7 feet deep from the ground down to the top of the vault.  The protective systems did not comply with the options in the standard in that on the west side, the excavation had a horizontal area about 3 feet wide at the top of the vault and then a 7-foot high vertical wall above this horizontal area rather than having 1:1 sloping; and on the north side, the excavation had a horizontal area about 4 feet wide followed by irregular benching rather than 1:1 sloping, exposing the worker to hazards, including, but not limited to, getting struck-by sliding/falling soil and rocks.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
