29 CFR 1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees are to work had the strength and structural integrity to support employees safely. Employees shall be allowed to work on those surfaces only when the surfaces have the requisite strength and structural integrity.  a. Charles Lowe work site located at 837 Buckingham St., Toledo, Ohio:  On or about October 14, 2019 the employer did not ensure the roof surface that employees were walking on, had the strength and structural integrity to support the employees safely.  An employee engaged in roofing work fell approximately 28 feet to the concrete below sustaining serious injuries when a section of the roof he was walking on could not support his weight.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.  a.
