29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: (a)K & A Roofing at 4700 South Technopolis Drive, Sioux Falls, SD 57106: On or about and at times prior to October 18, 2019, the exposing employer did not ensure that employees conducting roofing activities on a commercial roofing project were protected from falls. Employees were working on the roof near the edge without a fall protection system in place. This condition exposed employees to fall hazards of 11 and 16 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)K & A Roofing at 4700 South Technopolis Drive, Sioux Falls, SD 57106: On or about and at times prior to October 18, 2019, the employer did not ensure that each employee engaged in roofing operations on a commercial building, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The condition exposed employees to the hazard of falling from an elevation of approximately 11 feet and 16 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a)K & A Roofing at 4700 South Technopolis Drive, Sioux Falls, SD 57106: On or about and at times prior to October 18, 2019, the employer did not ensure the side rails of a portable extension ladder extended at least three feet above the roof line. Employees utilized a Keller, model #KMT22, extension ladder to access the roof. This condition exposed employees to a fall hazard of approximately 11 feet.
