OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:    a) Employees who entered a walk-in refrigerator (Serial#00000848) in the hot food area to retrieve raw cooking materials were exposed to the hazard of being struck by a malfunctioning RollSeal overhead door guarding the entrance to that refrigerator; Condition noted on 10/24/19.   IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.

29 CFR 1910.151(c): Where the eyes of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes were not available for immediate emergency use.  a)    In store:   Employees are required to use Stomp Cleaner/Degreaser which is a corrosive.  The eye wash station was not available for immediate emergency use as it was located at the opposite end of a 65,000 square foot store.  In the event of an emergency, employees would have to walk through the loading dock, warehouse and look behind a stairwell to reach  the eyewash.  Condition noted on 10/24/19.  Shoprite Supermarkets Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.151(c), which was contained in OSHA inspection number 1172695, citation number  1, item number 1 and was affirmed as a final order on 11/02/16, with respect to a workplace located at 46 Thompson Square Monticello, NY 12701.  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.
