29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about October 24, 2019, the employer did not provide a medical evaluation for an employee who was required to wear a 3M half mask negative pressure respirator. An employee used this respirator for protection against Brenntag Ferris Chloride 28% and Brenntag Hydrochloric Acid 20 BE NSF when they perform mixing of the chemical dyes and stains. (b) On or about October 24, 2019, the employer did not provide a medical evaluation for an employee who were required to wear a Honeywell Sperian Opti-Fit full face mask negative pressure respirator. An employee used this respirator for protection against Brenntag Ferris Chloride 28% and Brenntag Hydrochloric Acid 20 BE NSF when they perform mixing of the chemical dyes and stains.
