29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the areas in 29 CFR 1926.454(a)(1) through (a)(5):  The employer did not ensure employees who performed work on scaffolding were trained by a qualified person to recognize the hazards associated with fabricated framed scaffolding and the procedures to control or minimize the hazards including the following:  (1)  The nature of any electrical hazards, fall hazards and falling object hazards in the work area. (2)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used. (3)  The proper use of the scaffold, and the proper handling of materials on the scaffold. (4)  The maximum intended load and the load-carrying capacities of the scaffolds used. (5)  Any other pertinent requirements of this subpart.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.    On or about October 28, 2019, employees were exposed to fall hazards in excess of 15 feet when working on the cantilevered work platform installing a brick wall on a residential home located at 2700 Block Apple Hill Blvd Appleton, WI 54913.  The ends of the platform had no form of fall protection and only a single material platform at approximately top rail height was provided behind the employees as there was no cross bracing to act as a midrail.     Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.

29 CFR 1926.452(c)(2): Frames and panels shall be braced by cross, horizontal, or diagonal braces, or combination thereof, which secure vertical members together laterally. The cross braces shall be of such length as will automatically square and align vertical members so that the erected scaffold is always plumb, level, and square. All brace connections shall be secured.    On or about October 28, 2019, employees installing a brick wall for a residential home located at 2700 Block Apple Hill Blvd Appleton, WI 54913 were working from a four frame high fabricated framed scaffolding that was missing the cross braces in multiple frame sections.
