29 CFR 1926.1101(e)(5): The employer did not ensure that employees did not eat, drink, smoke, chew tobacco or gum, or apply cosmetics in the regulated area: (a) On or about October 23, 2019, the employer did not ensure that employees did not eat and drink in the regulated asbestos removal area. A drink was observed on the widow ledge by the negative air machine exhaust in the kitchen where asbestos floor covering was being removed.

29 CFR 1926.1101(g)(1): The employer did not use engineering controls and work practices in all operations covered by 29 CFR 1926.1101, regardless of the levels of the exposure: (a) On or about October 23, 2019, the employer did not use wet method type work practices in all operations to control employee exposures during asbestos handling, cutting, removal, and cleanup. This was observed by visual signs of dry sweeping and the lack of: wet surfaces, material dampness and water stains in the Kitchen and hallway where asbestos flooring and it's subfloor were being removed by hand methods. (b) On or about October 23, 2019, the enclosure to seal off the asbestos work zone from the rest of the house was not maintained in an intact state. Specifically, holes were in the polyethylene critical barrier used to isolate the living room from the asbestos flooring removal area, and the bottom of this critical barrier was not sealed to the floor. Additionally, holes in the kitchen sub floor were not sealed, allowing the falling of Asbestos containing dust and debris into the basement below. Further, there was no critical barrier or 'Z Flap' to cover the Kitchen back door, upper bedroom door and stairway to basement. (c) On or about October 23, 2019, street clothes were present inside the asbestos work area. Asbestos containing dust may be transferred to vehicles and to the employee's home on the contaminated clothing.
