29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) Market Place Vista Apartments, Roof: On or about 10/29/2019, and at times prior, the employer exposed employees to falls of approximately 42-feet, 6-inches from the lower ground level, in that a fall protection system was not used by the employee cutting and installing plywood sheathing on a 6/12 pitched roof.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Market Place Vista Apartments, Roof: On or about 10/29/2019, and at times prior, an employee was exposed to fall hazards on a steep 6/12 pitched roof at eave heights of 42-feet, 6-inches, in that the employee was not trained to install and don a complete personal fall arrest system when exposed to fall hazards. Training by a competent person was not provided or documented as the fall protection systems used on site were not adequate.
