29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) Tikal Inc located at 591 White Fawn Run, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that an evaluation of the industrial truck operators performance was being conducted at least once every three years. The on site supervisor was operating a JLG 8042 rough terrain forklift to lift materials to works on the second floor and roof of a new construction home. The supervisors proficiency had not been evaluated/certified in more than three years. The following condition exposed employees to struck by hazards.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) Tikal Inc located at 591 White Fawn Run, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that employees wore eye protection while utilizing pneumatic nail guns. Workers were installing sheathing and other framing pieces using electric and pneumatic nail gun powered at 120-150 psi without the use of eye protection. The following condition exposed employees to struck-by hazards to the eyes.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Tikal Inc located at 591 White Fawn Run, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing sheathing on the roof and other framing pieces on the garage trusses and near a window opening. The heights varied from 10-25 feet in the areas the framers were working. The employees were not utilizing fall protection which exposed them to falls up to 25 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) Tikal Inc located at 591 White Fawn Run, Delaware, OH 43015: On and preceding October 29, 2019, the employer did not ensure that the portable ladder used to gain access to the second floor extended at least three feet beyond the upper landing that they were using for access. The top of the window sill measured 13 feet above ground level with the ladder sections extending 1-6" beyond the sill used for access and neither section secured to the surface. One of two parts of an extension ladder that had been disassembled was utilized for access to the second floor. The two sections of the ladder were sitting next to eachother at the front of the house. This condition exposed the framers to falls up to 13 feet.
