29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about November 4, 2019, at the previously addressed job site, the portable ladder(s) used to access the roof did not extend at least three (3') feet above the upper landing surface, thereby exposing employees to the hazards associated with falls. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) On or about November 4, 2019, and times prior, the employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site made by a competent person. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d). To abate this hazard in the future, the employer must ensure that frequent and regular inspections of the job site made by a competent person. Hustad Companies, Inc. was previously cited for a violation of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2), which was contained in OSHA inspection number 1293487, citation number 1, item number 1, and was affirmed as a final order on May 14, 2018, with respect to a workplace located at 204 S. Brookwood Drive, Mt. Horeb, WI 53572. Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps will ensure frequent and regular inspections will be conducted.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On or about November 4, 2019, an employee performing residential construction activities (roofing) at heights more than 16 feet from the ground were not protected from falls, thereby exposing the employees to fall hazards. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
