29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: (a)Blind Creek Tiling, Inc. at 287th Street and 449th Avenue, Hurley, SD 57036: On or about and at times prior to September 30, 2019, the employer did not ensure employees installing and connecting drainage tile in a trench excavation were protected from injury by an effective employer implemented safety and health program. Abatement Note: A complete safety and health program includes the following elements: (1) Management Commitment and Leadership (a) Policy Statement: goals established, issued, and communicated to employees. (b) Program reviewed annually. (c) Participation in safety meetings, inspections; agenda item in meetings. (d) Safety rules and procedures incorporated into site operations. (2) Assignment of responsibility (a) Safety designee on site, knowledgeable and accountable. (b) Supervisor's (including foremen) safety and health responsibilities understood. (c) Employee adherence to safety rules. (3) Identification and Control of Hazards (a) Periodic site inspection program involving supervisors. (b) Preventative controls in place (PPE, maintenance, engineering controls). (c) Action taken to address hazards. (d) Safety committee, where appropriate. (e) Technical reference materials available. (4) Training and Education (a) Supervisors receive basic safety and health training. (b) Specialized training taken when needed. (c) Existence of an employee training program, which is ongoing and effective. (5) Recordkeeping and Hazard Analysis (a) Records maintained of employee illnesses/injuries and posted. (b) Supervisors perform accident investigations, determine causes, propose, corrective action. (6) First Aid and Medical Assistance (a) First aid supplies and medical services available. 29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. (a)Blind Creek Tiling, Inc. at 287th Street and 449th Avenue, Hurley, SD 57036: On or about and at times prior to September 30, 2019, the employer did not ensure employees installing and connecting drainage tile piping were protected from cave-ins. On September 30, 2019, an employee working in an excavation without a protective system was injured when the vertical wall of the trench caved in on the employee. The vertical wall of soil struck the employee, pinning him to the opposite wall resulting in serious injuries. The condition exposed both the employee to rescue the injured employee to struck-by and crushing injuries.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person prior to the start of work, and as needed throughout the shift, for evidence of situations that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: (a)Blind Creek Tiling, Inc. at 287th Street and 449th Avenue, Hurley, SD 57036: On or about and at times prior to September 30, 2019, the employer did not ensure that daily inspections of a trench approximately six feet deep by four foot wide and over 30 feet in length were made by a competent person for evidence of a situation that could have resulted in a hazardous condition. The competent person did not identify that the bottom of the trench had water accumulation and was over five feet deep with vertical sides. The spoil pile was directly adjacent to the edge of the excavation. This condition resulted in one employee sustaining injuries when the trench partially cave-in.

This condition exposed two employees to struck-by and crushing hazards.
