29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:  (a) Wellstar Avalon Health Park, Entrance to parking lot: On or about 10/25/2019, and at times prior, the employer exposed employees to struck-by hazards while cutting bricks with a Rigid 14-in. Chop Saw, in that; protective eyewear was not provided while employees were engaged in masonry activities using this saw without the guard in place.

29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:  (a) Wellstar Avalon Health Park, Entrance to parking lot: On or about 10/25/2019, and at times prior, the employer exposed employees to severe laceration and/or amputation hazards while cutting bricks with a Rigid 14-in. Chop Saw, in that the upper guard was tied back preventing the guard from retracting back over the blade after a cut was made.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a) Wellstar Avalon Health Park, Entrance to parking lot: On or about 10/25/2019, and at times prior, the employer exposed employees to respirable crystalline silica exposure while cutting bricks, in that the Rigid 14-in. Chop Saw was not used with an integrated water delivery system used for dry cutting bricks. No other engineering control was used to minimize the dust that was created with each cut.
