29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a) Four Star Trimming, LLC located at 214 Winter Shadow Loop, Delaware, OH 43015: On and preceding November 14, 2019, the employer did not ensure that employees wore eye protection while utilizing pneumatic nail guns. Workers were installing floor joists and other framing pieces using pneumatic nail guns powered at 90-120 psi without the use of eye protection. The following condition exposed employees to struck-by hazards to the eyes.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) Four Star Trimming, LLC located at 214 Winter Shadow Loop, Delaware, OH 43015: On and preceding November 14, 2019, the employer did not ensure that employees engaged in residential construction activities 6 feet or more above lower level were protected from falls. Framers were installing floor joists and other framing pieces on the second floor of a home that varied from 9-12 feet. The employees were not utilizing fall protection which exposed them to falls up to 12 feet.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Four Star Trimming, LLC located at 214 Winter Shadow Loop, Delaware, OH 43015: On and preceding November 14, 2019, the employer did not ensure that portable ladders used to gain access to the second floor joists and exterior walls extended at least three (3) feet beyond the upper surface that they were access.ing The surface being accessed measured 9-12 feet above ground level. A six and eight foot A-Frame were in place for access to the upper surface which were utilized by the framers. Framers were installing floor joists and other framing pieces on the second floor of a two story residential home that varied from 9-12 feet where work was taking place. This condition exposed the framers to falls up to 9 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: a) Four Star Trimming, LLC located at 214 Winter Shadow Loop, Delaware, OH 43015: On and preceding November 14, 2019, The employer did not ensure that the top step of the stepladder used for access to the upper level was not used. The surface being accessed measured 9-12 feet above ground level. A six and eight foot A-Frame were in place for access to the upper surface which were utilized by the framers which required the framers to use the top step when ascending/descending the upper surface. This condition exposed the framers to falls up to 8 feet.
