29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in a trench excavation that was 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:    a) DJ's Snowplowing & Maintenance, Inc., at 11008 Wheeling Court, Commerce City, CO, 80022: On or about 11/15/2019 the employer did not ensure that a safe means of egress was located in a trench excavation that was approximately 13.5 feet in depth. One employee was working in the trench hand digging around and making a utility connection for a future residence. This condition exposed an employee to trenching cave-in hazards.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:    a) DJ's Snowplowing & Maintenance, Inc., at 11008 Wheeling Court, Commerce City, CO, 80022: On or about 11/15/2019 excavations, the adjacent areas, and protective systems were not inspected by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. One employee was hand digging around and attaching a utility connection in a trench that was approximately 13.5 foot in depth without the use of a protective system. This condition exposed an employee to trenching hazards.
