29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided and used:    On or about November 18, 2019, the employer failed to ensure that each employee was provided with and used appropriate eye protection while using a pneumatic nail gun to secure shingles onto the roof of a residential structure, exposing them to eye injuries.    Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.     On or about November 18, 2019, employees performing installation operations on the upper level at a single family residential property were exposed to a fall of approximately 20.4' feet when the employer failed to ensure that fall protection was utilized.     No abatement certification or documentation is required for this item.
