(a) On or about 11/22/19, at an excavation located on 138 South Main Street, in Albion, New York, the employer did not protect employees working in a trench from falling debris and excavated materials by keeping spoil pile at least two feet from the trench edge. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) On or about 11/22/19, at an excavation located on 138 South Main Street, in Albion, New York, the employer did not protect employees working in a trench more than 5 feet in depth (5ft. 10in.) from cave-in hazards. The use of sloping, or benching or the use of support and shield systems were not in use. NO ABATEMENT CERTIFICATION REQUIRED
