29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a) Driven Excavating, LLC, on or about November 26th, 2019, at the location of Stumbo Rd./4th St., Ontario, OH, 44906: The employer did not ensure that employees working in an excavation 4 feet deep and greater had access to a ladder or other safe means of egress within 25 feet of lateral travel.  Employees climbing the spreader bars of the trench box to exit the excavation were exposed to potential same level slip, trip, and fall hazards.

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet (.61m) below the bottom of the members of a support system was permitted where the system was not designed to resist the forces calculated for the full depth of the trench and there were indications while the trench is open of a possible loss of soil from behind or below the bottom of the support system:      (a)    Driven Excavating, LLC, on or about November 26th, 2019, at the location of Stumbo Rd./4th St., Ontario, OH, 44906: The employer did not ensure that the excavation was not deeper than 2 feet below the trench box being utilized for cave-in protection while employees worked in the excavation.  The excavation was approximately 3 feet or greater depth below the trench box, which exposed the employees to potential struck by hazards should the box fall onto the employee working within the box.

29 CFR 1926.652(c)(3)(iii): At least one copy of the tabulated data, which identifies the registered professional engineer who approved the data, was not maintained at the jobsite during construction of the protective system.  (a) Driven Excavating, LLC, on or about November 26th, 2019, at the location of Stumbo Rd./4th St., Ontario, OH, 44906:  The employer neither possessed a copy of the tabulated data for the trench box being installed at the time of assembly and installation, nor maintained a copy of the tabulated data after installation.  Not maintaining this data exposed the employees to potential hazards related to incorrect use of the protective system.
