29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) On or about December 18, 2019, in the shooting range check in counter/range compliance, an employee working as a sales associate was exposed to continuous noise levels at 121.6% (91.4 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 157 minute sampling period. Zero exposure was assumed for the 323 minute period not sampled. The employer did not have a continuing and effective hearing conservation program. b) On or about December 18, 2019, in the shooting range check in counter/range compliance, an employee working as a sales associate was exposed to continuous noise levels at 88.16% (89.1 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 154 minute sampling period. Zero exposure was assumed for the 326 minute period not sampled. The employer did not have a continuing and effective hearing conservation program. c) On or about December 18, 2019, in the shooting range check in counter/range compliance, an employee working as a sales associate was exposed to continuous noise levels at 67.14% (87.1 dBA) of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 114 minute sampling period. Zero exposure was assumed for the 366 minute period not sampled. The employer did not have a continuing and effective hearing conservation program.

29 CFR 1910.134(f)(2): Employee(s) using a tight-fitting facepiece respirator were not annually fit tested: a) On or about December 18, 2019 and at times prior, the employer exposed employees to lead hazards, in that, they had not had annually fit tests for employees required to wear 3M 6300 half-faced respirators with 2091 dual particulate filters while performing gun range cleaning.
