OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and fall hazards while storing and retrieving merchandise in the warehouse unit:  a) On or about 10/08/2019, at the warehouse floor, the storage racks stacked with furniture merchandize were not anchored to the floor, exposing the employees to a struck-by and caught-in hazards.  b)  On or about 12/6/2019, at the warehouse floor, employees were using a pallet on a forklift as a platform to elevate them to reach merchandize off the racks, exposing them to fall hazards.

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:  a) On or about 11/05/2019, at the north side of the warehouse unit, the rear exit route from the building was completely blocked by a ladder, boxes, and other material, exposing employees to injuries in the event of an emergency evacuation.  b) On or about 11/05/2019, at the south side of the warehouse, the rear exit route was obstructed by mattresses and boxes such that only 17 inches of clearance was available, exposing employees to injuries in the event of an emergency evacuation.

Forklift operators had not been trained/evaluated on the type of forklift used at the facility. Employees used the forklift to load/unload material such as, but not limited to, carpet rolls and furniture.
