29 CFR 1926.651(h)(3): Excavations subject to runoff from heavy rains were not inspected by a competent person to ensure compliance with 29 CFR 1926.651(h)(1) and (h)(2):      a)  620 NJ 33 W, Millstone Township, NJ:  Employee was working in an unprotected excavation in water saturated soil, up to an estimated 4 1/2 feet to 5 feet or more in depth approximately 2-2 1/2 feet wide, on or about 12/03/2020.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    a)  620 NJ 33 W, Millstone Township, NJ:   Foreman #2 required his laborer to work in an unprotected excavation in water saturated soil, up to an estimated 4 1/2 feet to 5 feet or more in depth approximately 2-2 1/2 feet wide, when just a few feet away soil caving into the excavation has been observed, on or about 12/03/2020.     NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
