29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) New apartment construction located at building 200-A, 4th floor balcony: On or about 12/11/2019, and at times prior, the employer exposed employees to fall hazards of 43-feet from the lower level, in that the employer did not provide a fall protection system to employees engaged in framing activities.   b) New apartment construction located at building 200-A, 5th floor: On or about 12/11/2019, and at times prior, the employer exposed employees to fall hazards of 54-feet to the lower level, in that a fall protection system was not provided to employees installing ceiling/floor joists. A complete guardrail system was not erected along the open edges of the walking/walking surface.
