OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees  Location: 85 Metro Way Secaucus, NJ 07094   a) Employees engaged in warehousing activities are exposed to crushing hazards when operating forklifts without using the provided seat belt, or other means of restraint, to ensure they remain safely inside the operator's compartment in the event of sudden unexpected motion. The employer did not ensure that forklift operator restraint devices or seat belts were used during the first & third site visits on or about 12/10/19 and 2/26/2020.

Additionally, the line-of-sight to an exit sign must clearly be visible at all times.  Location: 85 Metro Way Secaucus, NJ 07094- Warehouse Processing  a) Employees exposed to smoke inhalation hazards; Multiple emergency exit signs were obstructed by stocked carboard materials and could not be observed by staff in the working area on or about 12/10/19.

29 CFR 1910.178(n)(4): The driver did not slow down and sound the horn at cross aisles and other locations where vision is obstructed. If the load being carried obstructs forward view, the driver shall be required to travel with the load trailing.  Location: 85 Metro Way Secaucus, NJ 07094 - warehouse  a) Employees exposed to struck by hazards; employee operating powered industrial vehicles throughout the warehouse without signaling in high traffic areas, pedestrian walk ways, aisles and other locations where vision was obstructed on or about 12/10/19.  b) Employee exposed to struck by hazards; employee operating a forklift while hauling palletized materials near the loading dock pedestrian walkway did not signal and struck another employee performing packaging operations. The incident occurred on or about 1/17/2020.
