The employer did not provide or ensure that a safe means of egress was located in the excavation. The trench used by employees measured approximately 26 feet in length, 5 feet wide and 5.5 feet deep.

An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift: On 12/13/2019, employees of Poeling Construction were connecting a 4 inch sewer system to a residential building located at 701 Tinsley Court, Cottleville, Missouri. The employer did not ensure a competent person inspected the excavation and surrounding areas to identify any potential hazards prior to the start of work.
