(a)  Jobsite:  On or about December 13, 2019, an employee was working in an approximately 11 foot deep excavation that had approximately 4 to 6 inches of standing water in it.  The excavation was dug earlier in the day and water was entering the excavation.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:   (a)  Jobsite:  On or about December 13, 2019, the owner and the foreman did not remove two employees who were working in an approximately 11 foot deep excavation.  None of the sidewalls were sloped nor shored.  In addition, there were no soil tests done to determine the class of soil.
