29 CFR 1926.20(b)(2):  The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials, and equipment to be made by a competent person.    On 8/19/2019, E&A Construction and Remodeling, Inc. performing masonry work at 1000 Fountain Grass Drive, Lake Saint Louis, MO.  E&A Construction and Remodeling, Inc. did not exercise reasonable care to prevent and detect hazards on the site.  Employees on the site were exposed to hazards including but not limited to: struck-by, and fall hazards as a result of frequent and regular inspections not being performed and corrected by a competent person.

29 CFR 1926.451(f)(3):  Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.     On 8/29/2019, employees from E&A Construction and Remodeling, Inc. were performing masonry work at 1000 Fountain Grass Drive, Lake Saint Louis, MO.  The employees were working from a tube welded scaffold system approximately 35 feet above the ground.  Scaffold and components were not visible inspected by a competent person.  Damage was observed on the scaffold platforms and base plates and mudsills were set in standing water.

29 CFR 1926.451(e)(1):  When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used. Crossbraces were used as a means of access.    On 8/19/2019 and 8/20/2019, employees from E&A Construction and Remodeling, Inc. were performing masonry work at 1000 Fountain Grass Drive, Lake Saint Louis, MO.  The scaffold being used was approximately 15-20 feet above ground level.  Employees were climbing on the crossbracing to access the lower and upper levels of the scaffold system.

On 8/19/2019; 8/20/2019; 8/22/2019 and 8/28/2019 employees from E&A Construction and Remodeling, Inc. were performing masonry work at 1000 Fountain Grass Drive, Lake Saint Louis, MO.  The employees were working from a tube welded scaffold system in excess of 10 feet above the ground without being protected from the hazard of falling.

Employees were not trained by a qualified person in hazard recognition for the tube welded scaffold.
