29 CFR 1926.602(d):  The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):    29 CFR 1910.178(l)(1)(i):  The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a)  On or about January 7, 2020, an employee was operating a V638 Versa Handler rough terrain forklift without ensuring they were competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation by a person with the knowledge, training and experience to do so.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):       a)  On January 7, 2020, employees were exposed to fall hazards of approximately 21.5 feet while performing carpentry work on the 3rd story deck of a home.      No abatement certification or documentation is required for this item.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a)  On or about January 7, 2020, employees were exposed to fall hazards while performing carpentry work and the employer did not provide a training program to recognize fall hazards and the procedures to be followed in order to minimize those hazards.      In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
