29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):  a)  On or about January 15, 2020, the employer did not initiate a program which provided for frequent and regular inspections of the job site by a competent person.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  On or about January 15, 2020, employees were exposed to fall hazards while performing masonry work and the employer did not provide a training program to recognize fall hazards and the procedures to be followed in order to minimize those hazards. 29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one stairrail system along each unprotected side or edge:  a)  On January 15, 2020, employees were accessing the upper floors of the building by way of stairways that did not have a stairrail system along the unprotected side.  No abatement certification or documentation is required for this item.
