29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  a)  On or about January 15, 2020, and times prior, the employer had not developed and/or implemented a written hazard communication program to address the hazardous chemicals used in the workplace and the hazards associated with those chemicals.   A written hazard communication program shall include the following elements, as applicable:  1. An inventory of all hazardous chemicals used in the workplace; 2. Labeling; 3. Maintaining of Safety Data Sheets for all hazardous chemicals, ensuring accessibility for employees; 4. Training; 5. Periodic review to address changes in the workplace.  Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  a) On or about January 14, 2020, and at times prior, the employer, did not ensure employees were protected from chemical hazards. Numerous secondary containers were used for exterior tire trim, interior cleaner, windshield washer fluid, tire and trim dressing, heavy duty cleaner and Acrysol high performance body solvent and did not have product identifiers on them to alert of hazards associated with each chemical.
