29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On January 21, 2020 at 303 Bay Park Square in Ashwaubenon, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards associated with employees using an aerial lift basket to access/egress a roof edge without guidelines installed as a path to a warning line system and an employee walking between the warning line system and unprotected roof edge to use a phone without utilizing fall protection equipment.

29 CFR 1926.502(f)(3): No employee shall be allowed in the area between a roof edge and a warning line unless the employee is performing roofing work in that area.  On January 21, 2020 at 303 Bay Park Square in Ashwaubenon, an employee was walking outside of a roof warning line system to an unprotected roof edge twenty-eight feet above surface level without utilizing fall protection equipment; the employee was using roof edge framework as a shelter from the wind for phone conversations.
