29 CFR 1910.95(g)(5)(i): The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared:  An audiometric testing program of employees was not instituted by Swanson Tools Co., Inc.  a. An maintenance technician/operator operating the vibratory equipment in the Vibration room was exposed to continuous noise levels at 147.4% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 147.4% is approximately 92.8 dBA.  The sampling was performed for 414 minutes during one shift on March 3, 2020.     b. An vibrator operator, operating the vibratory equipment was exposed to continuous noise levels at 374.3% of the allowable permissible exposure limit 8-hour time-weighted average sound level of 90 dBA. The equivalent dBA level of 374.3% is approximately 95.5 dBA.  The sampling was performed for 447 minutes during one shift on March 3, 2020.    c. An CNC worker, operating a CNC machine was exposed to continuous noise levels at 74.9% of the action level 8-hour  time-weighted average sound level of 85 dBA. The equivalent dBA level of 74.9% is approximately 87.9 dBA. The sampling was performed for 451 minutes during one shift on March 3, 2020.    d. An CNC worker, operating a CNC machine was exposed to continuous noise levels at 70.9% of the action level 8-hour  time-weighted average sound level of 85 dBA. The equivalent dBA level of 70.9% is approximately 87.5 dBA. The sampling was performed for 450 minutes during one shift on March 3, 2020.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a)  Vibratory Room - On or about March 4, 2020, the employer did not ensure that employees required to wear tight-fitting full-face respirators with a combination gas and vapor cartridges when working with chemical DP-9G (contains crystalline silica) were provided a medical evaluation to determine their ability to use a respirator.
