29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: On or about January 23rd, 2020, and at times prior thereto, employees were required to perform maintenance on vinyl record pressing machines, to include removing and replacing parts. The employer had not established a Lock-out Tag-out program or any other formalized energy control procedures, exposing employees to the hazard of being caught in moving parts due to the unexpected energization of machinery.

29 CFR 1910.1017(d)(1): A program of initial monitoring and measurement was not undertaken in each establishment to determine if there was any employee exposed, without regard to the use of respirators, in excess of the action level: On or about January 23rd, 2020, and at times prior thereto, the employer had no formal program related to vinyl chloride and had conducted no form of monitoring of measurement to determine airborne levels of vinyl chloride, exposing employees to the hazard of inhaling vinyl chloride gas. a) Two machine operators were sampled for their exposure to vinyl chloride during the heating and melting of PVC pellets. The personal air monitoring was conducted for 60 minutes and determined that employee exposure for that time period was 0.0ppm. b) One management representative was sampled for exposure to vinyl chloride during the heating and melting of PVC pellets. The personal air monitoring was conducted for 60 minutes and determined that manager exposure for that time period was 0.0ppm.
