29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A) Exterior on the ground: An employee was exposed to head injuries while working below another employee that was working on a scaffold above him. The employee was not protected by a hard hat or protective helmet, on or about December 4th, 2019. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Cross braces were used as a means of access. A) Exterior, On the scaffold: Employees were exposed to fall hazards of approximately 6 and 18 feet while climbing the scaffold components and were not provided with a safe an acceptable means of access, on or about December 4th, 2019.
