29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:    a) K & T Cabinets, wood working shop, Polson, MT: On or about January 29, 2020 employees were exposed to fall hazards while accessing the storage area to retrieve materials at a height of 10 feet 7 inches without fall protection.

29 CFR 1910.134(c)(2)(ii): The employer did not establish and implement those elements of a written program necessary to ensure that any employee using a respirator voluntarily was medically able to use that respirator, and that the respirator was cleaned, stored, and maintained so that its use does not present a health hazard to the user:    a) K & T Cabinets, wood working shop, Polson, MT: On or about January 29, 2020 and at times prior employees were exposed to health hazards in the Spray Area while spraying stain finish containing chemicals including, but not limited to, ethyl acetate, acetone, 1-butanol (KlearVar) while wearing a 3M half mask elastomeric respirator with combination cartridges. The employer failed to perform a medical evaluation of employees voluntarily wearing respirators.
