OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees draining/cleaning an atmospheric tank containing flammable materials.    (a) Shawn Harlan MSH Pad: On January 21, 2020, employees were using the top hatch of an atmospheric tank to drain flammable material without first controlling the ignition source such as the flare stack ignitor.    Among other methods, one or more feasible and acceptable methods of abatement to correct this hazard would be to follow a job hazard analysis process to identify and control ignition sources in the area of work before any work is performed that ight involve the release of flammable vapors.
