Employees were exposed to flying wood debris, plastic collated fragments and 2-3/8-in. fasteners.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a) New residential construction located on Lot #3, Upper Roof: On or about 01/31/2020, and at times prior, the employer exposed employees to fall hazards of approximately 28-feet to the lower level, in that a fall protection system was not used while installing 1/2-inch plywood on a 8/12 pitched roof.   (b) New residential construction located on Lot #3, Lower Roof: On or about 01/31/2020, and at times prior, the employer exposed employees to fall hazards of approximately 21-feet, 9-inches to the lower level, in that a fall protection system was not provided to employee using the 4/12 pitched lower roof as a walking/working surface to hand materials up to the employer working on the upper roof.
