29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: (a) Facility Wide - On February 4, 2020, the employer did not ensure that authorized forklift operators were provided an evaluation of their performance once every three years. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l): (a) Facility Wide - On February 4, 2020, the employer failed to certify that each temporary employee authorized to operate forklifts were certified after being evaluated with certification records that includes the name of the operator, the date of the training, the date of the evaluation and the identity of the person performing the evaluation. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. The sit down #18 Hyder forklift was in operation without a working horn to caution employees when entering blind spots. In accordance with the requirements of 29 CFR 1903.19(c), abatement certification only is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET.
