29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) 252-268 Avenue E, Bayonne, NJ and at the Corporate Offices at 298 Elm Street, Newark, NJ. Employees who worked in excavations and exposed to the hazards of excavation work were not trained in the recognition and avoidance of unsafe conditions and the regulations applicable to excavation work so that they would know how to control or eliminate hazards such as the excavation wall collapse that occurred. Violation occurred on or about 02/04/2020.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) 252-268 Avenue E, Bayonne, NJ. Employees were exposed to cave-in hazards as the employer did not have this excavation inspected by a competent person for evidence of hazards prior to workers going in the excavation as the employer was not familiar with the competent person function. Violation occurred on or about 02/04/2020.
