29 CFR 1910.106(e)(2)(iv)(c): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), may be used only where there are no open flames or other sources of ignition within the possible path of vapor travel.    On or about January 17, 2020 employees of Sheboygan Powersports, LLC were using gasoline as an accelerant to burn excess pallets at the N7402 Old HWY 42 South, Sheboygan, WI location. The gasoline container was left close to the open flames of the fire resulting in the container exploding as an employee attempted to remove the container.

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).    On or about February 12, 2020, employees operating the Clark Model C500 HY60 LP Forklift, Serial # HY685-55-2806 175, did not receive training prior to being allowed to operate the forklift.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.    On or about February 12, 2020, the Clark Model C500 HY60 LP Forklift, Serial # HY685-55-2806 175, located at N7402 Old HWY 42 South, Sheboygan, WI 53083 did not have an Operator Restraint System attached to the corresponding brackets of the lift.
