OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to a fall hazard.    a. On and/or before February 7, 2020, in the trailer shop, the employer did not ensure that a MEC Aerial Work Platform (model: Micro19; S/N: 16901881) used by employees was free from recognized hazards in that the platform entry gate was tied in the open position exposing employee(s) to a fall hazard.  On or about February 7, 2020, an employee performing work while in the MEC Aerial Work Platform fell approximately 10 feet due to the platform entry gate being secured in the open position.

29 CFR 1910.303(b)(1): Examination. Electric equipment shall be free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined using the following considerations:  1910.303(b)(1)(i) Suitability for installation and use in conformity with the provisions of this subpart; 1910.303(b)(1)(ii) Mechanical strength and durability, including, for parts designed to enclose and protect other equipment, the adequacy of the protection thus provided; 1910.303(b)(1)(iii) Wire-bending and connection space; 1910.303(b)(1)(iv) Electrical insulation; 1910.303(b)(1)(v) Heating effects under all conditions of use; 1910.303(b)(1)(vi) Arcing effects; 1910.303(b)(1)(vii) Classification by type, size, voltage, current capacity, and specific use; and 1910.303(b)(1)(viii) Other factors that contribute to the practical safeguarding of persons using or likely to come in contact with the equipment.    a. On and/or before February 20, 2020, in the trailer shop adjacent to the north personnel door, the employer did not ensure that the damaged and unsecured receptacle used to energize an extension cord and equipment was free from recognized hazards such as, but not limited to, the following:  not suitable for the installation and use and not safeguarded against employee contact.

29 CFR 1910.304(g)(5): Grounding path. The path to ground from circuits, equipment, and enclosures shall be permanent, continuous, and effective.   a. On and/or before February 20, 2020, in the trailer shop adjacent to the north personnel door, the employer did not ensure that the yellow extension cord used to power a Milwaukee Shear was grounded.  The plug end of the extension cord was missing the ground prong.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.     a.
