29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) Flynn Stone Design and Fabrication, Upper and Lower Saw Shops: An employee, saw operator, was exposed to continuous noise at 108.5% of the exposure level of 90 dBA or an 8-hour time-weighted average of 90.6 dBA. This exposure was observed over a 215 minute sampling period. Zero exposure was assumed for the time not sampled. The employer did not develop and implement a representative monitoring program for those employees exposed over the action level of 85 dBA, discovered on or about 2/25/2020. b) Flynn Stone Design and Fabrication, Upper and Lower Saw Shops: An employee, saw operator, was exposed to continuous noise at 110.9% of the exposure level of 90 dBA or an 8-hour time-weighted average of 90.7 dBA. This exposure was observed over a 212 minute sampling period. Zero exposure was assumed for the time not sampled. The employer did not develop and implement a representative monitoring program for those employees exposed over the action level of 85 dBA, discovered on or about 2/25/2020.
