29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5):  a.  On or about February 26th 2020 and at times prior, at 2220 N. Powerline Road, Pompano Beach FL 33069, employees were exposed to struck by hazards from forklift operators who were not certified to operate powered industrial trucks.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace:  a.  On or about February 26th 2020 and at times prior, at 2220 N. Powerline Road, Pompano Beach FL 33069, employees were exposed to struck by hazards from forklift operators who had not received formal instruction on how to operate a forklifts.
