29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):   On or about February 18, 2020, in front of a commercial development under renovation located at 460 S. Rosemary Avenue in West Palm Beach, Florida, an employee was exposed to a fall hazard of approximately 7-feet when performing stucco work from the work level platform of a fabricated frame scaffold that was not fully planked.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  On or about February 18, 2020, on site of a commercial development under renovation located at 460 S. Rosemary Avenue in West Palm Beach, Florida, an employee was exposed to a fall hazard when performing stuccowork from a fabricated frame scaffold prior to being provided a training program that would enable him to recognize the hazards associated with the scaffolding.

Rosemary Avenue in West Palm Beach, Florida, the employer did not report an inpatient hospitalization within 24 hours, when an employee sustained severe injuries from falling off a fabricated frame scaffold as he was performing stuccowork on February 18, 2020.

29 CFR 1910.1200(g)(8): The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):  On or about February 18, 2020, on site of a commercial development under renovation located at 460 S. Rosemary Avenue in West Palm Beach, Florida, employees were using chemicals including but not limited to Amerimix Preblended Scratch, Brown and Finish Stucco and Rinker Stucco Cement while the employer did not maintain the safety data sheets for that product at the worksite.
